Port A Escapes Vacation Rental Policies

 

Receipt of 25% of the total reservation is required to hold a reservation. The final balance is due 30 days prior to arrival. A refundable cash security deposit may be required during holidays and spring break or at Port A  Escapes’ discretion. 

 CHECK-IN/OUT 

 On the day of your arrival, when your property is cleaned, inspected and ready for you to check-in we will send out an e-mail and a text message with check-in instructions. 

 Check-in time begins at 4:00pm. Our staff will try their hardest to have your rental ready at that time, however, occasional unforeseen circumstances can hinder the check in time and 4:00pm is NOT guaranteed. Check-in instructions will be sent to the provided phone number on the day of arrival. Guests may request an early check-in for a fee of $50 however, we never know what may happen prior to a guest arrival so early check-ins are not guaranteed.

 Check-out time is 11:00 AM. You may arrange for a late check-out, if available, for a fee of $50/hour. Any guest staying past 2:00pm will be charged for an additional day of rent. 

CANCELLATION AND PAYMENT 

Port A  Escapes requires 25% of the total reservation cost to be paid at the time the reservation is made. The remaining balance is due 30 days prior to arrival. Reservations cancelled 31 days or more prior to arrival will receive a full refund minus a $50 cancellation fee. 

Cancellations made 30 days or less, prior to check-in will result in full forfeiture of all payments made. Applicable refunds will only be issued to the guest by the same form in which it was made, even if a credit card has since expired or been canceled. The above applies to moving dates or switching properties as well. We recommend that the guest purchase CSA Travel Protection. There are no refunds for early departures or late arrivals. If a guest does not show up for their stay the total amount paid is non-refundable. 

Visa, MasterCard, Discover, AMEX, cash or checks are accepted. A valid credit card is required if paying cash. The credit card used to make payment must be present at check-in along with a matching valid driver’s license. Make checks payable to Port A  Escapes. If paying your final balance by check, it must be received 30 days prior to check in or the reservation will be cancelled and all previous payments will be forfeited. 

OCCUPANCY AND AGE REQUIREMENTS 

Occupancy limits are posted on our web site and confirmed at time of reservation. If guest exceeds the occupancy limits, the guest will be asked to leave without a refund. Exceptions to the occupancy limit are only made for one infant under the age of two with prior approval. Additional visitors must also be pre-approved by Port A Escapes. 

Contracting guests of Port A Escapes must be 25 years of age or older. The guest must have a State Driver’s License or other acceptable ID. Port A Escapes reserves the right to refuse service to anyone. 

If the Occupancy Restrictions, as noted the Rental Agreement, are violated all guests will be evicted immediately and all deposits and rents will be forfeited. Renter agrees to be personally liable for the actions and for any damages accrued from everyone in their party during the dates of their reservation. ABSOLUTELY NO SUBLETTING IS PERMITTED ON PROPERTY. 

PET POLICIES 

Pets are only allowed in pet-friendly properties. There will be a $20 - $25 per night or $100 per month, per pet, charge for all pets staying at pet friendly properties, unless otherwise stated on the property listing. Additionally, a pet-cleaning fee is also charged, which is $50 for stays of 7 days or less, $75 for stays of 8-29 days, and $100 for stays of 30 or more days. 

All pets must always be leashed when at the beach or outside of the home. Pets must meet the guidelines set for that property or complex, such as weight limit, type, or maximum number of pets. If an unreported pet or a pet that exceeds the guidelines is found to be staying in a property, the guest will be charged $500 and be asked to leave without a refund.

PARKING, CONSTRUCTION, AND NEIGHBORS 

Guest agrees to use only the parking spaces provided for the property. Offending vehicles will be towed at your expense without notice. All vehicles must be parked in the driveway. No motor homes, RV’s or pop up campers are allowed at any properties. 

Port A  Escapes cannot predict construction or remodeling plans. You may book a property when construction is not underway but it could begin prior to your arrival. We apologize for any inconvenience that may result. We have no control over these situations and are not able to issue relocations or refunds.

 No loud music or parties at any property managed by Port A Escapes. Please respect your neighbors as you would in your own neighborhood. Renter shall not use rental or permit it to be used for any disorderly or unlawful purposes or in any manner that interferes with other residents. Violations of this rule could result in immediate eviction. Please observe speed limits at all times. Quiet hours are from 10pm to 8am. Port A  Escapes is not responsible for the actions of other guests. Should you have a problem with noise coming from another unit please contact the police department at 361-749-6241. 

PROPERTY CONDITION AND SUPPLIED ITEMS 

All of the vacation rental properties are individually owned. Each property reflects the taste of each owner. Port A  Escapes has made every effort to ensure property descriptions are accurate. However they are subject to errors or omissions and we cannot be held responsible for change of content and/or features, or removal by owner without notice. 

Each property will be equipped with sheets for every bed. Sheets for sleeper sofas, futons, trundle beds and rollaway beds will be in the master bedroom closet. One bath towel and one wash cloth will be provided for the maximum occupancy of the unit. One hand towel will be provided in each bathroom. All towels and linens provided in the unit are accounted for. Any missing, damaged or stained beyond repair items will result in charges to the credit card on file for the stay. 

Complimentary amenities will be provided in the property as a convenience until you have time to shop. These items include a sponge, bath soap, dish soap, dishwasher detergent, laundry detergent, paper towels, toilet paper, and trash bags. These items will not be replenished during your stay. Do not remove anything from the property.

 Do not take items from one property to another. This includes bath towels provided by Port A Escapes. These towels are not to be used at the pool or the beach. Each property is inspected (with an itemized list) upon departure. Anything missing from the property will be charged to the guest's credit card on file for the stay. 

MISC. FEES 

Cleaning fees vary by property and are based on square footage. There will be a $50 charge for lock outs, extra keys, or nonreturned keys. Each guest will be provided 2 keys per property at Check-in, if applicable. A $500 fine will be levied and immediate eviction for smoking in any property, no exceptions. Guests are welcome to smoke on the patios or decks outside. If the property is unusually dirty, the guest will be charged a $30 per hour cleaning fee, charged to your credit card. There is a 6% Service Fee on every reservation as well as a $2-$5 Marlin Legacy Foundation donation.

LOST OR FORGOTTEN ITEMS 

Check the property carefully before leaving. Port A  Escapes will not be responsible for items left in properties after check-out. Please notify us as soon as you realize you've forgotten something and we will make every effort to locate and return lost and forgotten items when the property is unoccupied but there is no guarantee they will be found. If a guest leaves an item in the property and wishes to have it mailed back to them they will be required to pay for the postage as well as a $25 service fee. Any forgotten items must be retrieved within 10 days or they will be donated to a local charity. 

HEATED POOLS 

Several complexes have seasonally heated pools. This means the pools will be heated in the winter months to maintain a maximum temperature of 83 degrees. Pool temperatures cannot be changed to accommodate personal preferences. 

MAINTENANCE 

All Port A Escapes properties are located on Port Aransas and experience harsher than normal wear and tear due to the constant exposure to our environment. Maintenance issues, electrical failures, and mechanical failures are rare and unfortunate and we regret any inconvenience that may result. However we have no control over these situations and are not able to relocate, discount or refund guests for issues with air conditioners, elevators, dishwashers, refrigerators, washers, dryers, cable or satellite TV, internet access, electricity, DVD players, swimming pools, hot tubs, or any other appliances or amenities. Please report any inoperative equipment or concerns as they occur and we will make every effort to resolve the problem as soon as possible. 

Filling the property refrigerator with food and/or drinks will cause it to overwork and not cool properly. It is normal for the refrigerator to take up to 24 hours to cool. Adjusting the temperature setting to its highest setting will only cause the unit to freeze up. Service calls for non-cooling refrigerators will not be addressed until the following morning. Any seafood or meat must be properly wrapped when placed in the refrigerator. 

HURRICANE AND MANADATORY EVACUATION POLICY 

We strongly recommend that guests purchase travel insurance for stays during hurricane season - June 1st through November 30th. In the event of an evacuation of Port Aransas, whether voluntary or mandatory, Port A Escapes will not issue refunds nor will we move the reservation to alternative dates. If you have declined travel insurance you shall not be entitled to a refund of any kind from Port A Escapes. Refunds for evacuation will be solely made by the travel insurance provider and according to the policies set by the travel insurance provider. 

OFFICIAL NOTIFICATION OF TRAVEL INSURANCE BEING OFFERED 

By signing our Rental Agreement each guest acknowledges being offered insurance to compensate the guest for losses or damages resulting from loss of use of the property due to an evacuation order. If the guest refuses said offer to purchase travel insurance, the guest shall not be entitled to a refund of monies paid. The guest also agrees to comply with all orders of evacuation.

 LIABILITY 

Unless caused by the home owner, owner is not responsible for personal injuries or property damage caused to renter or renter's guests or their property. Renter acknowledges the property may have bunk beds, the use of which is inherently dangerous. Renter assumes all liability for the use or misuse of said bunkbeds. Port A Escapes is not responsible for injuries to renters or renters guest excepting only intentional torts, or acts or omissions constituting gross negligence on the part of Port A Escapes or its staff. Renter agrees to indemnify Port A Escapes and hold same harmless in the event of legal action arising from renter's use of the property. 

Upon arrival renter agrees to notify Port A Escapes of any damages to the property. Renter agrees to accept responsibility for all damage caused by negligence or willful disregard by renter or renter's guests. The Reservation Fee covers up to $1,500 of accidental damage. The Reservation Fee shall be deemed invalid if the damage is not reported in writing to Port A Escapes prior to check-out. Port A Escapes is not responsible for renters' or renters' guest's personal property. 

RESERVATION FEE 

This Reservation Fee covers unintentional damages to the rental unit interior that occur during your stay, provided they are disclosed to management prior to check-out. The policy will pay a maximum benefit of $1,500. Any damages not covered or in excess of $1500 will be charged to the credit card on file. If, during your stay at one of our Rental Properties, a guest listed on the rental agreement causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the cost of repair or replacement of such property up to a maximum benefit of $1,500 will be covered. Damage caused by a pet or negligence on the part of the guest is not covered by the Reservation Fee. Certain terms and conditions apply. The Reservation Fee is required for every stay at all of our Rental Properties and it is not refundable.  PROPERTY ENTRY 

Representatives for Port A Escapes have the express right to enter the properties at any time, with or without the guest's consent to inspect the property or perform routine maintenance. Port A Escapes will make attempt to notify the renter if this should occur. 

GUEST COMMUNICATIONS

 By providing your phone number, you agree to receive SMS (text) communication from Port A  Escapes. Message and data rates may apply. Message frequency varies. You may opt in or out of messages at any time.

VENUE FOR DISPUTES 

Venue for any dispute arising out of this agreement or the rental period will lie exclusively in Nueces County, Texas. Should any legal action by owners become necessary to enforce this agreement, Renter agrees to pay all legal fees incurred by Port A Escapes, LLC, including costs and expenses.
